Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cash Advance by JST mobile application, the website at cashadvancebyjst.com, and associated services (collectively, the "Service"), operated by Cash Advance by JST Inc. ("JST," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, do not access or use the Service.

JST is not a lender. The Service is a lead-generation and matching platform that connects users with independent third-party financial partners. All lending decisions, loan terms, repayment obligations, and contractual relationships are determined exclusively by those third-party partners. We may receive a referral or marketing fee from a partner when you are connected through the Service.

1. Loan terms — APR, repayment, and fees

The Annual Percentage Rate ("APR") represents the annualized cost of borrowing and may include both interest and applicable fees. Representative offers shown through the Service generally range from approximately 4% to 35.55% APR, though individual lender offers may differ (for example, a partner lender may display a higher floor such as 6.99% APR). Final APR is determined by the lender based on factors including:

You will always be shown the final APR and key cost information before accepting any offer. State APR caps may further limit the maximum APR available in your state. JST requires its lender partners to disclose pricing in accordance with all applicable federal and state consumer-protection laws.

1.2 Repayment terms

Repayment terms vary by lender and financial product. Representative periods disclosed through the Service generally range from approximately 70 days up to 36 months. Individual lender offers may have longer terms where permitted by applicable law (for example, multi-year installment products). Before accepting any offer, you will receive a repayment schedule clearly stating: the total number of payments, the amount of each payment, and the due dates.

1.3 Payment frequency and methods

Payments are generally made in fixed installments. Depending on the lender and product, frequency may be weekly, biweekly, semi-monthly, or monthly. Repayments are typically processed by electronic bank transfer (ACH debit) from your designated account. Some lenders may offer alternative payment methods. You are responsible for ensuring sufficient funds are available on each due date to avoid late fees, returned-payment fees, or other charges permitted by applicable law.

1.4 Fees and other charges

Any potential fees associated with your offer — including origination fees, late payment fees, returned-payment or NSF charges, and expedited-funding fees (if offered) — will be clearly and fully disclosed by the lender before you accept the offer. You will always have an opportunity to review the total cost of credit, including all interest and fees, before agreeing to any loan or cash advance.

1.5 Early repayment

Many lenders available through the Service permit early payoff without a prepayment penalty, which may reduce the total interest you pay. Because policies vary by lender and state, please review your specific loan agreement to confirm how early payoff is handled.

1.6 Cost disclosure

Before you finalize any loan or cash advance, you will receive a standardized cost disclosure (such as a Truth-in-Lending Act ("TILA") disclosure or equivalent summary). This document will clearly outline APR; finance charges; total amount of all payments; number of payments and due dates; and any applicable fees. Review the disclosure carefully before accepting any offer, as it reflects the legally binding cost and repayment structure.

Some features of the Service require you to create an account. When registering, you agree to provide true, accurate, and verifiable information and to keep your information current. You must not share your login credentials, use another person's identity or account, or misrepresent any information during registration or use. We may take steps to verify your identity at any time. If we suspect fraudulent or unauthorized use, we may suspend, limit, or terminate access.

5. Electronic communications and E-Sign

By using the Service, you consent to receive electronic communications from us and, where applicable, from our partners. These may include emails; text messages (SMS), including one-time verification codes; in-App notifications; and electronic agreements, disclosures, and notices.

You understand and agree that electronic records, disclosures, and signatures carry the same legal effect as paper documents and handwritten signatures, consistent with the Electronic Signatures in Global and National Commerce Act ("E-SIGN Act") and applicable state laws.

You may withdraw your consent to receive electronic communications by contacting us at support@cashadvancebyjst.com. Withdrawing consent may prevent you from using certain features or completing future transactions. Even after withdrawal, we may still send communications that are legally required.

By submitting information through the Service, you expressly authorize JST to:

6.1 Credit Authorization

Separately from the broader data-sharing authorization above, by submitting a request through the Service you specifically authorize JST and the lender partners receiving your information to:

Hard credit inquiries. JST does not initiate hard credit inquiries. If you choose to proceed with a specific lender's formal application, that lender may perform a hard credit inquiry, which can lower your credit score by a few points and remain on your credit report for up to two years. The lender will obtain a separate authorization from you before performing any hard inquiry. You can decline to proceed at any time before that point.

This Credit Authorization is governed by the Fair Credit Reporting Act ("FCRA") and related federal and state laws. You may revoke this authorization at any time by contacting support@cashadvancebyjst.com; revocation will apply prospectively and will not affect inquiries already made.

7. Fees and our compensation

The Service is provided at no direct cost to users. JST does not charge you a fee to download or use the Service.

JST may receive a referral fee, marketing fee, per-lead fee, per-funded-loan fee, revenue share, or other valuable consideration from a lender, financial partner, marketing partner, or data buyer when users are connected through the Service or when users obtain a financial product through such a partner. Compensation may influence which partners receive your information first or how offers are ordered or displayed in the Service, but it does not change the APR, fees, repayment schedule, or other terms set by the lender on any offer you receive. Our compensation arrangements do not override our partners' obligations under applicable lending and consumer-protection laws. Detailed disclosures regarding compensation and the sale of personal information are in our Privacy Notice, Section 5.

You agree to use the Service only in compliance with these Terms and all applicable laws. You may not:

All content and technology associated with the Service — including text, logos, graphics, images, software, code, design, and data compilations — are owned by Cash Advance by JST Inc. or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, lawful, non-commercial use in accordance with these Terms.

If you submit ideas, suggestions, feedback, comments, or other materials regarding the Service, you grant JST a worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, modify, adapt, publish, and incorporate that feedback without restriction or compensation to you. You represent that your feedback does not infringe the rights of any third party.

THE SERVICE AND ALL RELATED INFORMATION, TOOLS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CASH ADVANCE BY JST INC. EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. USE OF THE SERVICE IS AT YOUR OWN RISK.

JST IS NOT A LENDER AND DOES NOT MAKE CREDIT DECISIONS. AVAILABILITY OF OFFERS, APPROVAL, FUNDING, AND TERMS ARE DETERMINED SOLELY BY THIRD-PARTY LENDERS AND ARE NOT GUARANTEED.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASH ADVANCE BY JST INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN ANY WAY RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY, OR ANY THIRD-PARTY PROVIDER'S PRODUCTS OR SERVICES, EVEN IF WE HAVE BEEN ADVISED THAT SUCH DAMAGES MAY OCCUR.

TO THE EXTENT ANY LIABILITY IS FOUND DESPITE THE ABOVE LIMITATIONS, THE TOTAL CUMULATIVE LIABILITY OF CASH ADVANCE BY JST INC. TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100).

Some states do not allow certain exclusions or limitations of liability. If you reside in such a state, some of the above limitations may not apply.

15. Indemnification

You agree to defend, indemnify, and hold harmless Cash Advance by JST Inc. and its affiliates, officers, directors, employees, partners, and agents from any claims, demands, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) that arise out of or relate to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement or violation of any rights of another person or entity.

16. Governing law and dispute resolution

16.1 Governing law

These Terms are governed by and interpreted in accordance with the laws of the State of Texas, without regard to its conflict-of-law rules, and applicable federal law.

16.2 Binding individual arbitration; class action waiver

Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service will be resolved by final and binding arbitration on an individual basis under the Federal Arbitration Act ("FAA"), rather than in court. You agree that:

Before initiating arbitration, you agree to first contact us at legal@cashadvancebyjst.com and provide a written description of the dispute. We will attempt to resolve the dispute informally within 30 days.

16.4 Exceptions

If arbitration is found unenforceable for a particular claim, or if the claim involves injunctive relief protecting intellectual property rights, that claim will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts. All other claims remain subject to arbitration.

17. Service changes and availability

JST may, at any time and without prior notice, add, change, or remove features or functionality; temporarily or permanently suspend all or part of the Service; or perform maintenance or updates that may affect availability. We are not responsible for any loss, inconvenience, or damages you may experience due to service interruptions or changes.

18. Termination

We may, at our sole discretion and without prior notice, suspend or terminate your access to the Service — including your account — if we believe you have violated these Terms or any applicable law, or that your use is harmful to us, our partners, or other users.

You may stop using the Service at any time by uninstalling the App and, if applicable, closing your account. Provisions that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution — will continue to apply.

19. Changes to these Terms

We may update or modify these Terms from time to time. When we do, we will update the Effective Date at the top. For material changes, we will provide additional notice, such as a prominent in-App notification and/or an email to the address associated with your account. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.

20. Apple-related terms (iOS users)

These Terms are an agreement between you and Cash Advance by JST Inc. only — not with Apple Inc. ("Apple"). Apple is not a party to these Terms and is not responsible for the App or its content. You acknowledge and agree that:
